The Home Office has published a draft version of its updated Employer’s Guide to Right to Work Checks, which is due to come into force on 1 October 2026, alongside with the implementation of s.48 of the Border, Security, Asylum and Immigration Act 2025, which extends the scope of the current right to work check regime in the UK.
The revised guidance extends the right to work check regime to also cover additional working arrangements, updates the list of acceptable documents to prove a right to work, and introduces revised terminology and requirements for Right to Work Digital Verification Service Providers (RtW DVSPs).
The revised guidance also clarifies supplementary employment rules, reflects changes to the Skilled Worker route, and aims to streamline the guidance by removing obsolete sections and consolidating information relating to EEA citizens.
In readiness for the changes coming into force on 1 October 2026, employers should review the draft Employer’s Guide to Right to Work Checks guidance now to understand the forthcoming changes and ensure their right to work check processes are able to accommodate the changes to the regime in October 2026.
