Family Law Fees

We understand that cost is a very real consideration for anyone deciding whether or not to seek legal advice, and in terms of who to instruct. Drummond Miller LLP has always tailored its services to families, individuals and small enterprises rather than large corporate entities, and our pricing structure reflects this.

Initial consultation

  • We offer an initial consultation (duration of up to an hour) for a fixed fee of £300, including VAT.
  • Where appropriate, we offer an initial free 15 minute consultation in order to discuss your circumstances and offer basic advice to allow you to take a decision as regards whether we are able to assist you.

 

Fixed fee divorce packages 

There are certain services which we can offer on a fixed fee basis. These are as follows:

  • Divorce on the basis of one year’s separation with the consent of your spouse, where there are children under 16 and there are no financial issues to resolve.  If such an action were not contested then our fee would be £1200 plus VAT and the applicable court dues (currently £265 but subject to an annual review).
  • Divorce on the basis of two years separation, where there are children under 16 and there are no financial issues to resolve.  If such an action were not contested then our fee would be £1100 plus VAT and the applicable court dues (currently £265 but subject to an annual review).
  • Divorce using the simplified process where you have been separated for over a year and your spouse consents, there are no children under 16, and there are no financial issues to resolve.  If such an action were not contested then our fee would be £450 plus VAT and the applicable court dues (currently £151 but subject to an annual review).       
  • Divorce using the simplified process where you have been separated for two years, there are no children under 16, and there are no financial issues to resolve.  If such an action were not contested then our fee would be £400 plus VAT and the applicable court dues (currently £151 but subject to an annual review).   

For all of the above, there may be additional outlays such as the cost for ordering further copies of Birth and Marriage Certificates, and the cost of serving court papers by Sheriff Officer, if that is necessary. These additional outlays would be discussed with you in advance.

If we are unable to offer a fixed fee, for example if the divorce is contested, or progressed on one of the fault-based grounds, then we will advise of the applicable hourly rate, dependent on the level of seniority of the solicitor. Our hourly rates typically range between £200 to £300. All hourly rates are exclusive of VAT and outlays.

Separation and disputes involving children

When couples separate there are often numerous issues which require to be resolved including issues to do with the parties’ financial situation, and also in relation to any children of the relationship.  It is not possible to charge a fixed fee for work of this type. This is because, at the outset, neither you nor we will know how much work will be required to bring the matter to a satisfactory conclusion. The advice and services offered by our experienced family law team can often be complex and time consuming.  Our fees are determined by the time we spend dealing with your case.  We will issue you with a Letter of Engagement which sets out the applicable hourly rate.  Our hourly rates typically range between £200 to £300 exclusive of VAT and outlays.

Legal Aid

We do offer legal aid for certain family law services.  We would discuss this fully with you and assess if we were able to make an application to the legal aid board on your behalf.
