What is Private Life?
Private life is essentially the life an individual builds up in the UK based on their length of residence and their ties in the UK. These ties can consist of friendships, family relationships, work, and study ties.
The protection of “private life” stems from the fact that Article 8 of the European Convention on Human Rights protects an individual’s right to private life. However, although Article 8 protects an individual’s right to private life, a state can interfere with an individual’s right to private life where this is necessary in order to protect the public interest.
Private Life and the Immigration Rules
The Immigration Rules lay down a set of very limited circumstances where an applicant can succeed in their application to remain in the UK based on their private life.
Where your application doesn’t meet all the specific requirements of the Immigration Rules, it is possible to make an application outside the Immigration Rules. However, such applications are granted only in very rare circumstances.
