
Can I still have a Will prepared?
Yes, as long as the usual tests are met (you are old enough and understand what you are doing), you can certainly still have a Will prepared.
To ensure that individuals are able to continue to have Wills put in place during the current restrictions, the guidance regarding the signing of Wills has changed. What has not changed is the need to get proper legal advice in relation to the preparation of a Will.
Should I try a homemade Will?
In the absence of the opportunity to have a face to face meeting with a solicitor, it might be tempting to have a go at a “homemade” Will.
This is, however, a very risky option and we would strongly urge clients to take proper legal advice (albeit by video call or telephone) to avoid the often unintended consequences of a homemade Will.
Over the years, our specialist executry team has encountered all kinds of problems with homemade Wills.
The first concern is the Will may not be valid at all and the rules of intestacy, which may benefit entirely different people to those that you have in mind, would apply.
Secondly, we often come across particular issues with homemade Wills that can lead to additional procedures becoming necessary after the testator has died. Dealing with this can be costly and very time-consuming.
