The e-visa system was incrementally rolled out in 2024. The roll out has not been smooth resulting in among other problems migrants being unable to view their status online or the incorrect status being displayed on their e-visa. Please see our previous blog containing general information in relation e-visas (Travelling Outside the UK? Make Sure Your UK eVisa is Current and Correct | Drummond Miller).
In response to criticism, the government has delayed full implementation of eVisas provisionally until 31 March 2025 for migrants who still have valid immigration status (Visa holders should switch to an eVisa now - GOV.UK). Concerns have been raised about problems that migrants will face when returning to the UK if their e-visa is not properly set up.
Individuals should carry their BRPs and BRCs with them when traveling for completeness. This is aimed to protect rights, in particular travel for migrants. The aim is to avoid issues with Border Control and airlines refusing entry to the UK to those with lawful and valid leave.
Government guidance states: “If your biometric residence card (BRC) issued through the EU Settlement Scheme or biometric residence permit (BRP) expires on or after 31 December 2024, you may be able to use your expired document to travel to the UK until 31 March 2025, where you continue to have permission to stay in the UK. You should carry it with you - your carrier may ask to see it.” (Check your eVisa is correct before you travel - GOV.UK)
Organisations such as the3million have heavily criticised the new online system and have called for a public enquiry to address the issues. (https://the3million.org.uk/news/2024-12-03/ministers-postpone-shift-to-evisas-amidst-systemic-failures-the3million-calls)
