
The immigration rules in relation to EU nationals have been ever evolving. There have been several changes and amendments of various procedures since the EU Settlement Scheme (EUSS) was first implemented.
On 17 July 2023, the Home Office announced further enhancements from September 2023. A welcomed enhancement is that the Home Office will grant an automatic two year extension for those who are eligible prior to the expiry of individuals’ current pre-settled status if settled status has yet to be granted. Therefore, protecting individuals without them having to make an application.
The Home Office have also said that from 2024 (at a date not yet set) they will automatically change the status of individuals who hold pre-settled status to settled status if they deem them to be eligible.
This will be a digital process where the Home Office have the ability to access online information such as HMRC/ national insurance records to check that the pre-settled status holder has maintained continuity of residence. The decision will then be reflected in the individual’s digital status and the Home Office will alert individuals directly using the information saved on their file. Thus, highlighting the importance of ensuring that those with status under the EUSS keep their digital status up to date so that the Home Office hold their most accurate and updated personal contact information.
There are also changes to the consideration of what constitutes reasonable grounds in relation to late applications under the EUSS which will render making a late application harder.
The Home office have also announced the closure of two temporary transitional routes falling out with the withdrawal agreement. The 8th August 2023 was the cutoff date for new applications as:
- Family member of a qualifying British citizen (known as ‘Surinder Singh’ cases)
- Primary carer of a British citizen (known as Zambrano cases)
