A parent of a qualifying child can apply for a visa to either enter or remain in the UK in order to have contact with that child.
Who is a qualifying child?
A qualifying child is a:
- Child under 18 who is a British citizen.
- A child who has lived in the UK for a continuous period of 7 years and who it would not be reasonable to expect to leave the UK.
What are the other requirements?
- The parent must provide evidence of direct contact with the child, either a Court order or a letter from the parent the child normally lives with.
- The parent must take an active role in the child’s upbringing.
- The English Language requirement must be met.
- The accommodation requirement must be met.
- The maintenance requirement must be met.
- The general grounds of refusal must not apply.
