We recently acted for First Glasgow (No 1) Ltd in an unusual case for interdict and damages in the Court of Session. The action was raised against a teenager who was suspected of vandalizing 26 of First Glasgow's buses by carving his initials or nickname into the seats and windows of the bus. He had caused thousands of pounds worth of damage and on one occasion, had vandalized a new bus that was only in circulation for one hour. First Glasgow had CCTV evidence of the majority of incidents which clearly identified the individual to blame.
Understandably, First Glasgow wished to take a zero tolerance approach to this type of behaviour and instructed Drummond Miller to issue urgent proceedings to prevent this individual from boarding any of their buses throughout the whole of Scotland. They also sought to recover damages for compensation for the cost of repairing the buses he had vandalized. The orders were granted unopposed.
More recently the individual concerned was convicted in the criminal courts of vandalism and received a community service order.
